CarBuyerIQ (trading as "CarBuyerIQ") is an AI-powered information and guidance service. All outputs, reports, scores, estimates, predictions, recommendations, scripts, and advice provided through our platform are general guidance and information only. They do not constitute professional, mechanical, financial, insurance, legal, or motoring advice. You must always seek independent professional advice before making any vehicle purchasing decision or relying on any information provided by our service. Dave is an AI assistant — he is not a qualified vehicle inspector, mechanic, engineer, financial adviser, or insurance broker.

1. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires, the following definitions shall apply:

  • "We", "Us", "Our", "the Company" means CarBuyerIQ, trading as CarBuyerIQ, with its principal office at Piccadilly Place, Manchester, M1 3BN, United Kingdom.
  • "You", "Your", "User" means any individual or legal entity who accesses, browses, or uses the Service.
  • "Service" or "Platform" means the CarBuyerIQ website, web application, APIs, and all related services operated by Us, including but not limited to vehicle intelligence reports, fuel price information, vehicle guides, and the Ask Dave AI chat feature.
  • "Dave" means our AI-powered vehicle analysis assistant, which generates reports, verdicts, scores, predictions, and guidance using artificial intelligence technology. Dave is not a natural person, qualified mechanic, vehicle inspector, or professional adviser of any kind.
  • "Report" or "Vehicle Report" means any vehicle intelligence report generated by the Service, including health scores, risk badges, AI verdicts, MOT analysis, cost estimates, negotiation scripts, inspection checklists, and all associated content.
  • "AI Content" means any content, text, analysis, prediction, recommendation, script, estimate, score, or output generated in whole or in part by artificial intelligence, machine learning, or algorithmic processing.
  • "Guidance" means general information, indicative estimates, educational content, and informational outputs provided through the Service. Guidance is expressly not professional advice of any kind.
  • "Health Score" means the proprietary numerical score (0–100) generated by our algorithmic scoring engine based on available MOT and DVLA data. It is an indicative metric only and not a professional vehicle assessment.
  • "Data Sources" means the third-party data providers from which we obtain vehicle and related information, including but not limited to the Driver and Vehicle Licensing Agency (DVLA), the Driver and Vehicle Standards Agency (DVSA), the GOV.UK Fuel Finder service, and publicly available vehicle listing platforms.
  • "Subscription" means a recurring paid plan granting access to premium features of the Service on a monthly billing cycle.
  • "Single Report Purchase" means a one-off payment granting full premium access for one specific vehicle.
  • "Account" means a registered user account on the Platform.
  • "Dealer Account" means a business or organisation account with access to dealer-specific features including bulk upload, team management, and inventory tools.
  • "Third-Party Services" means any external services, APIs, platforms, or websites not owned or operated by Us.

2. About Us

CarBuyerIQ operates under the trading name "CarBuyerIQ". Our principal place of business is at Piccadilly Place, Manchester, M1 3BN, United Kingdom. You may contact Us by email at hello@davethecarexpert.co.uk or via our Contact page.

3. Acceptance of Terms

By accessing, browsing, registering for, or using any part of the Service, you confirm that:

  • You have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
  • You are at least 18 years of age and have the legal capacity to enter into a binding contract.
  • If you are using the Service on behalf of a business, organisation, or other legal entity, you have the authority to bind that entity to these Terms.
  • You understand and accept that the Service provides general guidance and information only, and that all outputs are generated by artificial intelligence and algorithmic processing.
  • You will not rely on the Service as a substitute for independent professional advice, inspections, or assessments.

If you do not agree to any part of these Terms, you must not use the Service.

4. Nature of Our Service — Guidance Only

Critical Disclaimer

All outputs from CarBuyerIQ — including but not limited to vehicle reports, health scores, risk assessments, AI verdicts, cost estimates, depreciation forecasts, insurance insights, negotiation scripts, inspection checklists, buying advice, market valuations, MOT predictions, component lifecycle estimates, fuel price data, and Ask Dave chat responses — are general guidance and information only. They do not constitute and must not be treated as professional advice of any kind.

Without limiting the generality of the foregoing:

  • Not mechanical or automotive advice. Dave is an AI assistant. He is not a qualified vehicle inspector, mechanic, automotive engineer, or MOT tester. Our Service does not and cannot replace a physical inspection of any vehicle by a qualified professional.
  • Not financial advice. We are not authorised or regulated by the Financial Conduct Authority (FCA). No output from our Service constitutes financial advice within the meaning of the Financial Services and Markets Act 2000. All cost estimates, depreciation forecasts, ownership projections, insurance insights, running cost calculations, true cost per mile figures, market valuations, and pricing recommendations are indicative estimates only.
  • Not insurance advice or quotes. Insurance estimates provided by the Service are rough indicative ranges based on general assumptions. They are not insurance quotations, and we are not acting as an insurance broker, intermediary, or adviser. You must obtain actual quotations from authorised insurance providers.
  • Not legal advice. Nothing in our reports, guides, or AI outputs constitutes legal advice. This includes but is not limited to our negotiation scripts, seller questions, and walk-away triggers.
  • Not a vehicle history or provenance check. Our reports are not and must not be treated as an HPI check, finance check, stolen vehicle check, insurance write-off check, or provenance verification. We do not verify V5C logbook details, outstanding finance, theft records, or insurance write-off status.

You must always seek independent professional advice — including but not limited to a professional independent vehicle inspection by a qualified mechanic or vehicle inspector, an HPI or equivalent provenance check, actual insurance quotations from FCA-authorised providers, and independent financial advice where appropriate — before making any decision to purchase a vehicle or relying on any information provided by our Service.

Our Service exists to inform, educate, and assist consumers in understanding publicly available vehicle data. It is designed to complement — never to replace — professional advice and independent due diligence.

5. Description of Services

Subject to these Terms, the Service provides the following features (availability may vary by plan):

  • Vehicle Intelligence Reports: AI-powered analysis of vehicles based on MOT history and DVLA data, including health scores, risk badges (Buy/Caution/Avoid), AI verdicts, vehicle stories, at-risk components, component wear timelines, recall alerts, and MOT national comparisons.
  • Financial Estimates: Running cost estimates, cost forecasts, true cost per mile calculations, depreciation curves, five-year ownership projections, depreciation outlooks, and insurance insights. All financial outputs are estimates only.
  • Buying Toolkit: Buyer's briefs, negotiation playbooks with suggested scripts, personalised inspection checklists, questions for sellers, and walk-away triggers.
  • Ask Dave AI Chat: An interactive AI chat feature allowing users to ask vehicle-specific questions. Responses are AI-generated guidance only.
  • Make and Model Intelligence: AI-generated information about known issues, common faults, and reliability patterns for specific vehicle makes, models, and year ranges.
  • "Cars to Avoid" Recommendations: AI-generated lists of vehicle models with historically elevated failure rates or known defects, based on MOT statistics and documented issues.
  • Fuel Price Service: An interactive fuel price map, fuel station finder, fuel price alerts, fuel trend charts, trip cost calculator, and daily fuel digest — sourced from the GOV.UK Fuel Finder API.
  • Vehicle Guides and Content Library: Editorially published and AI-assisted vehicle buying guides, model-specific insights, and informational articles.
  • Repair Cost Intelligence: A tool providing estimated repair costs based on aggregated data and user-submitted information.
  • MOT Preparation: MOT prep checklists, first MOT predictions, and risk simulators.
  • PDF Report Export: Downloadable branded PDF versions of vehicle reports.
  • Dealer and Organisation Features: Bulk vehicle upload, team management, and inventory tools for business users.

We reserve the right to add, modify, suspend, or discontinue any feature of the Service at any time, with or without notice. Material changes to paid features will be communicated with reasonable notice.

6. AI-Generated Content Disclaimer

A significant proportion of the content provided through our Service is generated in whole or in part by artificial intelligence and algorithmic processing. You acknowledge and agree that:

  • AI Content may be inaccurate, incomplete, out of date, or misleading. Artificial intelligence systems, including those powering our Service, are imperfect and may produce errors.
  • AI Content is generated based on patterns in data and does not reflect the considered opinion of any qualified human professional.
  • Dave (our AI assistant) has no physical access to any vehicle. He cannot see, touch, hear, smell, or physically inspect any vehicle. His analysis is based solely on digital data records.
  • AI Content cannot assess the actual mechanical condition, structural integrity, cosmetic state, or roadworthiness of any vehicle.
  • All AI-generated predictions, scores, estimates, and recommendations are probabilistic in nature and carry inherent uncertainty. Actual outcomes may differ materially from any prediction or estimate.
  • We do not warrant, guarantee, or represent that any AI Content is accurate, reliable, complete, or fit for any particular purpose.
  • You must independently verify all AI-generated information before relying on it for any purpose, including but not limited to vehicle purchasing decisions.
  • We use third-party AI providers (including but not limited to OpenAI) to generate certain content. We do not control and are not responsible for the outputs of these third-party AI systems.

7. Health Scores, Risk Assessments and Predictions

Our Service generates various scores, risk assessments, and predictions. You acknowledge and agree that:

  • Health Scores are generated by a proprietary algorithm that analyses available MOT and DVLA data. They are an indicative metric designed to provide a general impression of a vehicle's documented history. They are not a professional vehicle condition assessment and should never be treated as such.
  • Risk Badges (Buy, Caution, Avoid) are algorithmically generated classifications based on the Health Score and other data points. They represent our system's automated assessment only and should not be the sole basis for any purchasing decision.
  • MOT Failure Predictions are probabilistic estimates expressed as percentage ranges. They are based on historical advisory-to-failure conversion rates derived from aggregate MOT statistics. Actual failure rates for any individual vehicle may differ significantly from these estimates.
  • Component Lifecycle Estimates (expected remaining life of brake pads, tyres, shock absorbers, and similar components) are based on industry-average mileage ranges. Actual component life depends on numerous factors including driving style, road conditions, maintenance quality, and environmental conditions, none of which our system can assess.
  • First MOT Predictions for newer vehicles are based on national average first-MOT failure statistics. Individual vehicle outcomes will vary.
  • All scores and predictions are based on data that may be incomplete, delayed, or contain errors originating from third-party Data Sources.

8. Financial Information Disclaimer

Our Service provides various financial estimates and projections. You acknowledge and agree that:

  • All financial outputs are estimates only. Running cost estimates, depreciation forecasts, cost-per-mile calculations, ownership projections, repair cost estimates, and any other financial figures are approximate calculations based on industry averages, standard assumptions, and publicly available data. They are not guaranteed and should not be relied upon as accurate forecasts of actual costs.
  • We do not provide financial advice. We are not authorised or regulated by the Financial Conduct Authority. No output from our Service constitutes financial advice within the meaning of the Financial Services and Markets Act 2000 or any successor legislation. You must seek independent professional financial advice before making any financial decisions.
  • Insurance estimates are not quotations. Any insurance group estimates, premium ranges, or insurance-related guidance are rough indicative figures based on general assumptions about vehicle type, age, and engine size. They do not account for your personal circumstances, driving history, location, claims record, or any other individual rating factor. You must obtain actual quotations from FCA-authorised insurance providers. We do not act as an insurance intermediary, broker, or adviser.
  • Market valuations are estimates. Any market value, fair price range, or price position guidance is an estimate based on available comparable data. It does not constitute a professional vehicle valuation under RICS (Royal Institution of Chartered Surveyors) or any other professional valuation standard. Actual market values depend on vehicle condition, local demand, mileage, specification, service history, and numerous other factors that our system cannot fully assess.
  • Repair cost estimates are averages. Estimated repair and maintenance costs are based on aggregated average data and may vary significantly by geographic location, garage or dealership, parts availability, vehicle specification, and the specific nature of any defect.
  • Negotiation price guidance is informational only. Suggested offer ranges and discount percentages are algorithmically generated guidance. They do not represent guaranteed achievable prices and do not account for all factors that influence real-world negotiations.
  • Depreciation forecasts are projections. Depreciation curves and value projections are based on historical average depreciation rates by vehicle age and type. Actual depreciation depends on mileage, condition, market demand, model popularity, economic conditions, and other variables that cannot be accurately predicted.
  • Running costs assume standard usage. Annual running cost estimates are typically based on an assumed annual mileage of approximately 7,900 miles (the UK average). If your actual mileage differs, all related estimates will be inaccurate.

9. Vehicle Data and Third-Party Data Sources

Our Service relies on data obtained from third-party sources. You acknowledge and agree that:

  • Vehicle data is sourced from the Driver and Vehicle Licensing Agency (DVLA), the Driver and Vehicle Standards Agency (DVSA) MOT history service, the GOV.UK Fuel Finder service, and other third-party data providers.
  • We are not responsible for the accuracy, completeness, timeliness, or reliability of any data obtained from third-party Data Sources, including government APIs.
  • Government API data may be delayed, incomplete, temporarily unavailable, or contain errors that are outside our control.
  • Our Service employs data caching to improve performance. This means that information displayed may not reflect the most recent data available from the original source.
  • MOT history data is only as complete as the records held by the DVSA. There may be gaps, errors, or omissions in the official record.
  • Fuel prices are obtained from the GOV.UK Fuel Finder API and are indicative. They may not reflect actual pump prices at any given station at the time you visit. Not all UK fuel stations participate in the government reporting scheme.
  • We make no warranty or representation regarding the freshness, accuracy, or completeness of any data displayed on the Platform.
  • Where we display data from publicly available vehicle listings (such as advertised prices or descriptions from third-party platforms), we are not responsible for the accuracy of that listing data, which is provided by the seller or listing platform.

10. Limitations of Vehicle Reports

Vehicle Reports generated by our Service have inherent limitations that you must understand before use. You acknowledge and agree that:

Our Reports are based solely on publicly available digital data — primarily MOT test history from the DVSA and vehicle registration data from the DVLA. They are not and must not be treated as a comprehensive vehicle condition assessment.

Our Reports do NOT include and are NOT a substitute for:

  • A professional physical vehicle inspection by a qualified mechanic or vehicle inspector
  • An HPI check or equivalent provenance/history check
  • An outstanding finance check
  • A stolen vehicle check
  • An insurance write-off (Category S, N, B, or A) check
  • V5C (logbook) verification
  • Full service history verification
  • An accident or damage history check
  • A mileage verification beyond what is recorded in MOT tests
  • An emissions or roadworthiness test

Our Reports cannot detect:

  • Undisclosed accident damage, repairs, or bodywork
  • Flood, fire, or storm damage
  • Mileage discrepancies occurring between MOT tests (including odometer tampering not reflected in the MOT record)
  • Mechanical faults that have developed since the most recent MOT test
  • Electrical faults, software issues, or infotainment problems
  • Interior condition, wear, staining, or damage
  • Cosmetic condition, paintwork defects, or rust not recorded in MOT tests
  • Tyre condition beyond what was recorded at the most recent MOT test
  • Modifications, aftermarket parts, or non-standard alterations
  • Outstanding manufacturer recalls that have not been actioned

You must obtain a professional independent vehicle inspection before purchasing any vehicle. Our Reports are designed to supplement — never to replace — proper professional due diligence. Any decision to purchase or not purchase a vehicle is entirely your own responsibility.

11. Fuel Price Service

Our fuel price service provides fuel station locations, fuel prices, price trends, price alerts, and trip cost calculations. You acknowledge and agree that:

  • Fuel price data is sourced from the GOV.UK Fuel Finder API, a UK Government service. We do not independently verify fuel prices.
  • Prices displayed may not reflect the actual price at any specific fuel station at the time of your visit. Prices are updated periodically and there may be a delay between price changes at the pump and their reflection on our Platform.
  • Not all UK fuel stations are included in the government's reporting scheme. Our fuel map may not show all stations in a given area.
  • Trip cost calculations are estimates based on assumed fuel consumption figures derived from engine capacity data. Actual fuel consumption depends on driving style, vehicle condition, road conditions, traffic, weather, and other factors.
  • Fuel price alerts are informational notifications only. They do not constitute financial advice or a recommendation to purchase fuel at any specific time or location.
  • We are not responsible for any errors, omissions, or inaccuracies in fuel price data originating from the government API or any other data source.

12. User Accounts and Registration

To access certain features of the Service, you may need to create an Account. By registering, you agree that:

  • You will provide accurate, current, and complete information during registration and keep your Account information up to date.
  • You are responsible for maintaining the confidentiality and security of your Account credentials, including your password.
  • You are responsible for all activity that occurs under your Account, whether authorised by you or not.
  • You will notify Us immediately at hello@davethecarexpert.co.uk if you become aware of any unauthorised use of your Account.
  • You may not create more than one Account per individual, share your Account credentials with any third party, or transfer your Account to another person.
  • We reserve the right to suspend or terminate any Account that we reasonably believe has been created with false information, is being shared or misused, or is in breach of these Terms.

13. Free and Paid Services

The Service offers both free and paid features:

  • Free Tier: Basic vehicle reports including health scores, AI verdicts, MOT history analysis, risk assessments, and access to our vehicle guide library. Limited to 5 reports per calendar month.
  • Premium Subscription (£9.99 per month): Unlimited vehicle reports with full premium features including cost forecasts, depreciation curves, insurance insights, negotiation scripts, inspection checklists, seller questions, walk-away triggers, Ask Dave AI chat, and PDF report export.
  • Single Report Purchase (£4.99): Full premium access for one specific vehicle registration, as a one-off purchase.
  • Dealer Plans: Business-grade access with pricing, features, and terms as agreed separately. Contact Us for details.

All prices are inclusive of VAT where applicable. We reserve the right to modify our pricing, features, and plan structure at any time. Changes to pricing for existing subscribers will be communicated with at least 30 days' notice.

14. Subscription Terms and Auto-Renewal

  • Premium Subscriptions are billed monthly and renew automatically on each monthly anniversary of your initial subscription date.
  • By subscribing, you authorise Us (via our payment processor, Stripe) to charge your chosen payment method on each renewal date until you cancel.
  • You are responsible for ensuring that your payment method remains valid and has sufficient funds. If a renewal payment fails, we may retry the charge and/or suspend your access to premium features.
  • You may cancel your Subscription at any time through your billing settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing period — you will retain access to premium features until that date.
  • No partial refunds are given for unused portions of a billing period following cancellation.
  • We reserve the right to change Subscription pricing. Any price increase for existing subscribers will take effect at the start of the next billing period following at least 30 days' notice.

15. Payments and Refunds

  • All payments are processed securely by Stripe, our third-party payment processor. We do not store your full credit or debit card details on our servers.
  • By making a payment, you warrant that you are authorised to use the payment method provided.
  • No refunds. Due to the nature of our Service as digital content that is delivered immediately upon purchase (see Section 16 below), we do not offer refunds for Single Report Purchases or Subscription charges. Refunds may be considered in exceptional circumstances entirely at our sole discretion.
  • If a refund is granted at our discretion, it will be processed to the original payment method.
  • Fraudulent chargebacks or disputes made in bad faith may result in immediate suspension or permanent termination of your Account.

16. Digital Content and Cancellation Rights

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Consumer Contracts Regulations") provide consumers with a 14-day cancellation right for most distance contracts. However, the Regulations provide an exception for digital content.

By making a purchase on our Platform (whether a Single Report Purchase or a Subscription), you:

  • Expressly consent to the immediate provision and delivery of digital content (your vehicle report or access to premium features) before the expiry of the 14-day cancellation period; and
  • Acknowledge that by giving this consent, you will lose your right to cancel under Regulation 37(1)(a) of the Consumer Contracts Regulations once the digital content has been accessed or delivered.

This consent is obtained at the point of purchase, prior to payment being processed.

Once a Report has been generated or premium features have been accessed, no cancellation refund is available, as permitted by the Consumer Contracts Regulations.

For Subscriptions, you may cancel future automatic renewal at any time (see Section 14). Cancellation of a Subscription prevents future charges but does not entitle you to a refund for the current or any previous billing period during which the Service was available to you.

Nothing in this Section affects your statutory rights under the Consumer Rights Act 2015 in respect of digital content that is not of satisfactory quality, not fit for a particular purpose, or not as described.

17. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any unlawful, fraudulent, or harmful purpose, or in connection with any unlawful, fraudulent, or harmful activity.
  • Attempt to gain unauthorised access to any part of the Service, other user accounts, or any systems or networks connected to the Service.
  • Use automated tools, bots, scrapers, crawlers, or similar technology to access, extract, or index data from the Service without our prior written consent.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or scoring models of the Service.
  • Circumvent, disable, or interfere with any access controls, rate limits, security features, or usage restrictions of the Service.
  • Use data obtained from the Service to create, operate, or contribute to any competing product or service.
  • Reproduce, redistribute, resell, sublicense, or commercially exploit any content, reports, or data obtained from the Service, except as expressly permitted by these Terms.
  • Submit false, misleading, or inaccurate information to the Service, including incorrect vehicle registration numbers or listing URLs.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
  • Share your Account credentials with any third party or allow any third party to access the Service through your Account.
  • Use the Service to harass, defame, threaten, or discriminate against any person.

We reserve the right to investigate any suspected breach of this Section and to take appropriate action, including suspension or termination of your Account and, where appropriate, reporting to law enforcement authorities.

18. Intellectual Property

  • Our Intellectual Property. All content, software, algorithms, scoring models, AI models (as configured and prompted by Us), branding, trademarks, trade names (including "CarBuyerIQ", "CarBuyerIQ", and "Dave"), logos, designs, text, graphics, images, and all other materials on or forming part of the Service are owned by Us or licensed to Us and are protected by copyright, trademark, and other intellectual property laws of England and Wales and international treaties.
  • Limited Licence. Subject to these Terms, We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and to view, download, and print Reports generated for your Account, solely for your personal or internal business use.
  • Report Sharing. You may share individual Reports with third parties via the share link functionality provided by the Service. You may not reproduce, redistribute, or commercially exploit Reports in bulk or in any systematic manner.
  • Restrictions. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, publish, display, modify, create derivative works from, sell, license, or otherwise exploit any part of the Service or its content.
  • User Data. You retain ownership of any vehicle registration numbers, listing URLs, or other data you submit to the Service. By submitting such data, you grant Us a licence to use, process, and store that data as necessary to provide the Service and for anonymised, aggregated analytical purposes.
  • Aggregated Data. We may use anonymised, aggregated data derived from the use of the Service (which does not identify any individual user) for research, service improvement, statistical analysis, and commercial purposes.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
  • We expressly disclaim all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
  • We do not warrant that any Report will identify all defects, issues, risks, or problems with any vehicle, or that any score, prediction, or estimate will be accurate.
  • We do not warrant that AI-generated content will be accurate, appropriate, complete, up to date, or free from error.
  • We do not warrant that data from third-party Data Sources (including government APIs) will be accurate, complete, or available.

Nothing in these Terms excludes or limits your statutory rights as a consumer under the Consumer Rights Act 2015, including your rights in respect of digital content that is of satisfactory quality, fit for a particular purpose, and as described.

20. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any other matter for which it would be unlawful for Us to exclude or limit our liability.

Subject to the paragraph above, and to the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, howsoever arising, including but not limited to loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill, loss of data, or loss of anticipated savings.
  • We shall not be liable for any loss or damage arising from or in connection with any decision you make (including any decision to purchase, not purchase, sell, or not sell a vehicle) based in whole or in part on any Report, score, estimate, prediction, recommendation, guidance, or other output of the Service.

  • We shall not be liable for any loss or damage arising from the unavailability of the Service or any third-party API or data source on which the Service depends.
  • Our total aggregate liability to you in respect of all claims arising under or in connection with these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you have paid to Us in the 12 months immediately preceding the event giving rise to the claim; or (b) one hundred pounds sterling (£100).

  • You are solely responsible for seeking and obtaining independent professional advice before making any decision based on information from the Service;
  • All vehicle purchasing decisions and associated financial decisions are entirely your own responsibility;
  • The limitations and exclusions of liability set out in this Section are reasonable given the nature of the Service as an information and guidance platform, the pricing of the Service, and the availability of independent professional advice; and
  • These limitations and exclusions of liability shall apply whether or not We have been advised of or should have been aware of the possibility of any such losses arising.

21. Indemnification

You agree to indemnify, defend, and hold harmless CarBuyerIQ, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms;
  • Your misuse of the Service;
  • Your reliance on any output of the Service as a substitute for independent professional advice;
  • Any third party's reliance on a Report or other Service output that you shared with them;
  • Your violation of any applicable law, regulation, or third-party right; or
  • Any content, data, or information you submit to the Service.

  • We collect Account information, vehicle registration numbers searched, usage data, device and browser information, and payment information (processed by Stripe).

23. Third-Party Services and Links

  • The Service integrates with and relies upon various third-party services, including but not limited to the DVLA Vehicle Enquiry API, the DVSA MOT History API, the GOV.UK Fuel Finder API, Stripe (payment processing), and third-party AI providers.
  • We have no control over the availability, accuracy, content, policies, or practices of any third-party service. We are not responsible for any loss or damage arising from the use of, or reliance on, any third-party service.
  • The Platform may contain links to third-party websites or services. Such links are provided for your convenience only and do not constitute an endorsement, sponsorship, or recommendation by Us. You access third-party websites and services entirely at your own risk.
  • Your use of third-party services (including Stripe for payments) is subject to the respective third party's own terms and conditions and privacy policies.

24. Service Availability and Modifications

  • We aim to ensure the Service is available at all times but do not guarantee continuous, uninterrupted, or error-free availability. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
  • The Service depends on the continued availability and proper functioning of third-party APIs (including government APIs operated by the DVLA, DVSA, and GOV.UK). If these APIs become unavailable, degraded, modified, or discontinued, some or all features of the Service may be affected. We are not liable for any such disruption.
  • We reserve the right to modify, update, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. Where a material change affects paid features, We will endeavour to provide reasonable advance notice.
  • We are not liable for any loss or inconvenience arising from any period of Service unavailability or from any modification or discontinuation of features.

25. Account Termination

  • By Us. We may, at our sole discretion and without prior notice, suspend or permanently terminate your Account and access to the Service if we reasonably believe that you have breached these Terms, are engaging in fraudulent or abusive behaviour, have provided false information, or are using the Service in a manner that is harmful to Us, other users, or third parties. We may also terminate accounts for non-payment of Subscription fees.
  • By You. You may close your Account at any time by contacting Us at hello@davethecarexpert.co.uk. If you have an active Subscription, you should cancel it before closing your Account to avoid further charges.
  • Effect of Termination. Upon termination, your right to access the Service ceases immediately. We may, at our discretion, retain or delete your data in accordance with our Privacy Policy. Termination does not affect any rights or obligations that accrued prior to termination, nor does it entitle you to any refund.
  • Surviving Clauses. Sections 4 (Guidance Only), 6 (AI Disclaimer), 8 (Financial Disclaimer), 10 (Report Limitations), 15 (Payments and Refunds), 16 (Digital Content), 18 (Intellectual Property), 19 (Disclaimer of Warranties), 20 (Limitation of Liability), 21 (Indemnification), 22 (Privacy), 29 (General Provisions), and 30 (Governing Law) shall survive termination of these Terms.

26. Email Communications

By creating an Account or using certain features of the Service, you may receive email communications from Us. These include:

  • Transactional Emails: Report completion notifications, payment receipts, Account-related alerts, and other service-critical communications. These are sent as a necessary part of providing the Service and are not marketing communications.
  • Marketing Emails: Product updates, feature announcements, promotions, and newsletters. These are only sent with your consent, and you may opt out at any time using the unsubscribe link in any marketing email or through your email preferences in your Account settings.
  • Fuel Price Alerts: If you configure fuel price alerts, you will receive notification emails based on your selected criteria. You may modify or disable these alerts at any time.

We comply with the Privacy and Electronic Communications (EC Directive) Regulations 2003 and the UK GDPR in relation to all email communications.

27. Dealer and Organisation Terms

If you register for a Dealer Account or Organisation Account, the following additional terms apply in addition to all other provisions of these Terms:

  • Business Use. Dealer Accounts are intended for use by motor vehicle dealers and related businesses. You warrant that you are operating as a legitimate business.
  • Consumer Protection Compliance. If you use any data, reports, or content from the Service in connection with the sale of vehicles to consumers, you remain solely responsible for ensuring compliance with all applicable consumer protection legislation, including but not limited to the Consumer Rights Act 2015, the Consumer Protection from Unfair Trading Regulations 2008, and the Sale of Goods Act 1979 (as amended). Our Reports are not consumer-facing compliance documents and must not be presented to consumers as a substitute for statutory rights or professional assessments.
  • Team Management. If you invite team members to your Organisation, you are responsible for their compliance with these Terms and for managing their access permissions appropriately.
  • Bulk Upload. When uploading vehicle data in bulk, you warrant that you have the right to process and submit the data, and that the data is accurate to the best of your knowledge.
  • No Endorsement. You may not represent or imply that CarBuyerIQ or CarBuyerIQ endorses, approves, or recommends any specific vehicle you are selling, or that our Reports constitute a certification or guarantee of any vehicle's condition.

28. Force Majeure

We shall not be liable for any failure or delay in the performance of our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, flood, earthquake, fire, storm, or other natural disasters;
  • Epidemics or pandemics;
  • War, armed conflict, terrorism, riot, or civil unrest;
  • Government actions, sanctions, embargoes, or regulatory changes;
  • Outages, modifications, or discontinuation of third-party APIs (including DVLA, DVSA, and GOV.UK services);
  • Internet or telecommunications failures, including distributed denial-of-service attacks or other cyber attacks;
  • Power failures;
  • Strikes, lockouts, or other industrial action; or
  • Failure of third-party service providers, hosting providers, or cloud infrastructure.

29. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Us in relation to your use of the Service and supersede all prior agreements, understandings, and representations.
  • Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
  • No Waiver. No failure or delay by Us in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that or any other right, power, or remedy.
  • Assignment. You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any third party without your consent, provided that such assignment does not reduce the protection afforded to you under these Terms.
  • Third-Party Rights. These Terms are not intended to confer any benefit on, or be enforceable by, any person who is not a party to them. The Contracts (Rights of Third Parties) Act 1999 does not apply to these Terms.

30. Governing Law and Jurisdiction

  • These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
  • The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to the following.
  • If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
  • If you are a consumer resident in a part of the United Kingdom other than England and Wales, you may bring proceedings in the courts of the part of the United Kingdom in which you are resident.

31. Changes to These Terms

  • We may revise and update these Terms from time to time at our sole discretion. The revised Terms shall be effective from the date of publication on the Platform, as indicated by the "Last updated" date at the top of this page.
  • For material changes that significantly affect your rights or obligations, We will endeavour to provide at least 30 days' notice by email to registered users and/or by prominent notice on the Platform.
  • Your continued use of the Service after the publication of revised Terms constitutes your acceptance of the revised Terms. If you do not agree to any revised Terms, you must stop using the Service and, if applicable, cancel your Subscription.
